    Il corso si propone di preparare lo studente ad un’adeguata conoscenza della genesi e dello sviluppo delle grandi linee evolutive del costituzionalismo in età moderna e contemporanea. Si propone altresì di offrire allo studente alcuni strumenti concettuali per una valutazione critica e consapevole delle principali e varie forme di organizzazione del potere.

    Obiettivi formativi

    Conoscenza e capacità di comprensione: dimostrare la conoscenza della genesi del costituzionalismo moderno attraverso l’analisi dei diversi sistemi politico-costituzionali (1- knowledge and understanding). Conoscenza e capacità di comprensione applicate: dimostrare di avere capacità critica nello studio delle fonti storico-giuridiche di riferimento ai fini della contestualizzazione temporale e dell’interpretazione dei problemi giuridici e dei rapporti di forze nonché delle principali soluzioni individuate nelle diverse epoche. Capacità di cogliere la dimensione storica del linguaggio giuridico e i profili non solo normativi, ma anche politici del diritto, anche attraverso l'attività interpretativa dei giuristi (2- applied knowledge and understanding). Autonomia di giudizio: dimostrare autonoma capacità interpretativa delle fonti e dei processi storico-politici, basata sulla comprensione critica del sapere giuridico e dei fenomeni politici in chiave sistematica e interdisciplinare (3- making judgements). Abilità comunicative: dimostrare di saper comunicare in modo chiaro e senza ambiguità le proprie conoscenze (in forma scritta od orale), di saper esprimere le proprie considerazioni e conclusioni anche nell’ambito del dibattito su casi oggetto di specifica analisi collettiva (working class) che potrebbe realizzarsi nel corso delle lezioni frontali o nei seminari di approfondimento tematici organizzati. Lo studente deve dimostrare di saper esporre le nozioni acquisite con coerenza argomentativa, rigore logico-sistematico e proprietà di linguaggio (4- communication skills). Capacità di apprendere: dimostrare di aver sviluppato capacità di comprendere la complessità del fenomeno storico-giuridico, nonché le capacità di apprendimento che possono consentirgli di proseguire nello studio della disciplina in modo autonomo e consapevole, anche mediante un aggiornamento costante delle proprie competenze (5- learning skills).

    Metodologie didattiche

    Lo studente può acquisire le conoscenze e le capacità di comprensione attraverso la fruizione di forme di didattica tradizionali (didattica frontale: lezioni, esercitazioni, ecc.).

    Metodi di valutazione

    Prova orale o prova scritta. Per la prova scritta è necessaria una preventiva richiesta al docente (Questo indirizzo email è protetto dagli spambots. È necessario abilitare JavaScript per vederlo.) almeno 5 giorni prima della data dell’appello per il quale si è effettuata la prenotazione.
    Entrambe le modalità di verifica dell'apprendimento mirano ad accertare il livello di conoscenza degli argomenti indicati nel programma e a verificare che lo studente abbia acquisito conoscenza della disciplina, capacità di interpretazione dei fenomeni, capacità di esposizione chiara e ragionata in coerenza con i descrittori dei risultati di apprendimento indicati nel campo Obiettivi formativi.
    La prova orale consiste in un colloquio articolato e la valutazione rispetta i seguenti criteri: • Mancato superamento dell’esame: preparazione insufficiente • Da 18 a 21: preparazione sufficiente con specifico riguardo al punto 1 degli Obiettivi formativi • Da 22 a 24: preparazione pienamente sufficiente con specifico riguardo ai punti 1 e 2 degli Obiettivi formativi • Da 25 a 26: preparazione buona con specifico riguardo ai punti 1, 2 e 3 degli Obiettivi formativi • Da 27 a 29: preparazione molto buona con specifico riguardo ai punti 1, 2, 3, e 4 degli Obiettivi formativi • Da 30 a 30 e lode: preparazione ottima/eccellente con specifico riguardo ai punti 1, 2, 3, 4, 5 degli Obiettivi formativi. La prova scritta consiste in un test che prevede 15 domande a risposta multipla e 4 domande a risposta aperta. La valutazione corrisponde ai punteggi maturati per le risposte fornite ai quesiti del test: - per ciascuna domanda a risposta multipla la risposta corretta comporta l’attribuzione di un punteggio pari a 1; - per ciascuna domanda a risposta aperta la risposta corretta comporta l’attribuzione di un punteggio da 0 a 4 a seconda che la risposta dimostri un livello di preparazione insufficiente, sufficiente, buono, molto buono o eccellente; - la risposta corretta a tutte le domande a risposta multipla unita alla risposta che dimostri un livello di preparazione eccellente per tutte le domande a risposta aperta comporta l’attribuzione finale del voto di 30 con lode; - il mancato raggiungimento del punteggio minimo di 18/30 comporta il mancato superamento dell’esame.

    Programma del corso

    Il corso intende stimolare la riflessione sulle linee di sviluppo della tradizione storico-costituzionale europea e fornire gli strumenti necessari alla comprensione della storia costituzionale in età moderna e contemporanea (età delle origini, età delle rivoluzioni, età liberale, età delle
    costituzioni democratiche), con particolare riguardo alla sovranità, al potere costituente, alle libertà fondamentali. Questi obiettivi saranno perseguiti attraverso l’analisi delle diverse esperienze costituzionali e delle dottrine che hanno ispirato le costituzioni moderne.Nell’ambito del corso saranno trattati i seguenti temi:Le origini del costituzionalismo (didattica frontale pari a 1 CFU)Il costituzionalismo britannico (didattica frontale pari a 0.8 CFU)Il costituzionalismo americano (didattica frontale pari a 0.8 CFU)Le costituzioni francesi del periodo rivoluzionario (didattica frontale pari a 0.8 CFU)Il costituzionalismo della Restaurazione: le Chartes del 1814 e 1830 (didattica frontale pari a 0.8 CFU)La costituzione di Weimar (didattica frontale pari a 0.8 CFU)Le dinamiche costituzionali dello Stato italiano dall’Unità ad oggi (didattica frontale pari a 1 CFU).

    The course aims to prepare the student for an adequate knowledge of the genesis and development of the great evolutionary lines of constitutionalism in the modern and contemporary age. It is also proposed to offer the student some conceptual tools for a critical and conscious evaluation of the main and various forms of power organization.

    Course objectives

    Knowledge and understanding: demonstrating the knowledge of the genesis of modern constitutionalism through the analysis of different political-constitutional systems (1- knowledge and understanding). Applying knowledge and understanding: demonstrating that you have critical skills in the study of historical-juridical sources of reference for the temporal contextualization and interpretation of legal problems and the relationship of forces as well as the main solutions identified in different eras. Ability to grasp the historical dimension of legal language and not only regulatory, but also political profiles of law, also through the interpretative activity of jurists (2- applied knowledge and understanding). Making judgments: demonstrating autonomous interpretative skills of historical-political sources and processes, based on a critical understanding of legal knowledge and political phenomena in a systematic and interdisciplinary key (3- making judgments). Communication skills: demonstrating the ability to clearly and unambiguously communicate one's own knowledge (in written or oral form), to be able to express one's own considerations and conclusions even in the context of the debate on cases subject to specific collective analysis (working class) which could take place during frontal lectures or organized thematic in-depth seminars. The student must demonstrate the ability to present the acquired knowledge with argumentative consistency, logical-systematic rigor and language properties (4- communication skills). Ability to learn: to demonstrate the ability to understand the complexity of the historical-juridical phenomenon, as well as the learning skills that can allow it to continue in the study of the discipline in an autonomous and conscious way, also through a constant updating of its own skills (5- learning skills).

    Teaching methods

    The student can acquire the knowledge and comprehension skills through the use of traditional forms of teaching (lectures: lectures, exercises, etc.).

    Evaluation methods

    Both learning assessment methods aim to ascertain the level of knowledge of the topics indicated in the program and to verify that the student has acquired knowledge of the discipline, ability to interpret the phenomena, clear and reasoned exposure capacity consistent with the descriptors of the results learning opportunities indicated in the Educational objectives field.
    The oral test consists of an articulated interview and the assessment meets the following criteria: • Failure to pass the exam: insufficient preparation • From 18 to 21: sufficient preparation with specific regard to point 1 of the educational objectives • From 22 to 24: preparation fully sufficient with specific regard to points 1 and 2 of the educational objectives • From 25 to 26: good preparation with specific regard to points 1, 2 and 3 of the educational objectives • From 27 to 29: very good preparation with specific regard to points 1, 2 , 3, and 4 of the educational objectives • From 30 to 30 cum laude: excellent / excellent preparation with specific regard to points 1, 2, 3, 4, 5 of the educational objectives. The written test consists of a test that includes 15 multiple choice questions and 4 open-ended questions. The evaluation corresponds to the scores earned for the answers given to the questions of the test: - for each multiple choice question the correct answer involves the attribution of a score equal to 1; - for each open-ended question the correct answer involves the attribution of a score from 0 to 4 depending on whether the answer demonstrates an insufficient, sufficient, good, very good or excellent level of preparation; - the correct answer to all the multiple choice questions together with the answer that demonstrates an excellent level of preparation for all the open-ended questions involves the final attribution of the grade of 30 with honors; - failure to achieve the minimum score of 18/30 leads to failure to pass the exam.

    Course Syllabus

    The course aims to stimulate reflection on the lines of development of the European historical-constitutional tradition and provide the tools necessary for the understanding of constitutional history in the modern and contemporary age (age of the origins, age of the revolutions, liberal age, age of the democratic constitutions), with particular regard to sovereignty, constituent power, fundamental freedoms. These objectives will be pursued through the analysis of the different constitutional experiences and doctrines that inspired modern constitutions. The following topics will be covered in the course: The origins of constitutionalism (1 CFU frontal teaching) British constitutionalism (teaching frontal equal to 0.8 CFU) American constitutionalism (frontal teaching equal to 0.8 CFU) The French constitutions of the revolutionary period (frontal teaching equal to 0.8 CFU) The constitutionalism of the Restoration: the Chartes of 1814 and 1830 (frontal teaching equal to 0.8 CFU) The Weimar Constitution (frontal teaching equal to 0.8 CFU) The constitutional dynamics of the Italian State from Unity to today (frontal teaching equal to 1 CFU).
