Contenuti | Il corso avrà ad oggetto: L’ evoluzione storica della nozione giuridica di straniero e delle norme sulla condizione dello straniero; I principi giuridici della normativa vigente: profili amministrativistici, profili penalistici, profili civilistici; Cenni generali sull’organizzazione dell’Amministrazione dell’Interno e sulle competenze dei vari Enti; La disciplina dell’ingresso e del soggiorno in Italia; Il contrasto all’immigrazione clandestina La protezione internazionale e le sue declinazioni: diritto di asilo/status di rifugiato, la protezione sussidiaria, la protezione umanitaria; Il sistema di accoglienza; Diritti e doveri degli stranieri. |

Obiettivi formativi | Il Corso ha l’obiettivo di fornire un’adeguata conoscenza del diritto dell’immigrazione mediante un approccio teorico e pragmatico, consentendo agli studenti di padroneggiare, con adeguata terminologia giuridica e rigore logico, i concetti fondamentali della materia. A tal fine verranno analizzate le discipline normative relative all’immigrazione prendendo in considerazione la normativa dell’Unione europea (e il suo impatto nell’ordinamento italiano) e quella italiana. Le tematiche del diritto dell’immigrazione verranno trattate concentrandosi sulle questioni principali e sugli aspetti di più stringente attualità. L’analisi della giurisprudenza e di alcuni casi pratici e la discussione in aula favoriranno lo sviluppo di un approccio critico alle tematiche oggetto del corso, consentendo agli studenti di maturare la propria chiave di lettura anche rispetto a questioni di stretta attualità. |

Contents | The course will focus on: The historical evolution of the legal notion of foreigners and the rules on the condition of foreigners; The legal principles of current legislation: administrative profiles, criminal profiles, civil profiles; General notes on the organization of the Interior Administration and on the competences of the various Bodies; The regulation of entry and stay in Italy; The fight against illegal immigration International protection and its forms: right of asylum / refugee status, subsidiary protection, humanitarian protection; The reception system; Rights and duties of foreigners. |

Course objectives | The course aims to provide adequate knowledge of immigration law through a theoretical and pragmatic approach, allowing students to master, with adequate legal terminology and logical rigor, the fundamental concepts of the subject. To this end, the regulatory disciplines relating to immigration will be analyzed taking into consideration the European Union legislation (and its impact in the Italian legal system) and the Italian one. The issues of immigration law will be dealt with by focusing on the main issues and the most pressing aspects. The analysis of jurisprudence and some practical cases and the discussion in the classroom will favor the development of a critical approach to the topics covered by the course, allowing students to develop their own interpretation also with respect to strictly topical issues. |
