Contenuti | Il Corso consiste in 2 moduli. Il primo presenta agli studenti un ordinamento, quello internazionale, creato dagli Stati a partire dal ‘700 per disciplinare i loro rapporti attraverso un meccanismo di diritti e doveri reciproci. In particolare, il Corso illustra i caratteri fondamentali di questo ordinamento, completamente diverso da quello interno, a partire dalla soggettività internazionale fino alle funzioni dell’ordinamento, ossia funzione normativa, funzione esecutiva e funzione di accertamento, approfondendone i caratteri precipui e l’obiettivo del mantenimento della pace e della sicurezza internazionali. |

Obiettivi formativi | Il corso intende fornire conoscenze di base sull’ordinamento internazionale e sull’ordinamento dell’Unione europea (UE). Nello specifico il corso si propone di fornire un quadro generale della natura e struttura e delle funzioni normativa, di accertamento e esecutiva nei due ordinamenti nonché far conoscere alcune tematiche di attualità nel settore. |
Prerequisiti | Non è prevista alcuna propedeuticità. Tuttavia, in considerazione del suo contenuto, è opportuno che gli studenti abbiano conoscenze di base del diritto pubblico e del diritto privato, secondo i programmi previsti nella laurea triennale in Scienze Politiche, oltre che una certa conoscenza di inglese e francese. |
Metodologie didattiche | Il corso si articola in lezioni frontali (90%) e nell’esame di casi pratici e o dibattiti in aula (10%) per un totale di 72 ore. I casi pratici saranno affrontati attraverso l'analisi della prassi relativa e della giurisprudenza internazionale ed europea. I dibattiti affronteranno tematiche di rilievo contemporaneo. |
Metodi di valutazione | A scelta dello studente l'esame può essere orale o scritto, in entrambi i casi con votazione in trentesimi. Il voto minimo per superare l'esame è di 18/30. L'esame orale, che consiste in un colloquio, si svilupperà su sei domande (tre sul diritto internazionale e tre sul diritto UE). L'esame scritto consiste in un test che comprende 24 domande a risposta multipla (12 di diritto internazionale e 12 di diritto UE) e 1 domande a risposta aperta (in diritto internazionale). In entrambe le modalità l'esame è volto a verificare il livello di conoscenza degli argomenti del programma e trattati durante le lezioni, il livello di padronanza del linguaggio giuridico specialistico proprio della materia. |
Altre informazioni | Gli studenti possono sostenere una prova parziale sul 1° modulo del corso, ossia sulle “Istituzioni di diritto internazionale”, e una prova finale sul 2° modulo del corso, ossia sulle “Istituzioni di diritto dell’Unione europea”. Il voto finale risulterà dalla somma delle due prove divisa per 2. Prova parziale e prova finale si terranno negli usuali appelli di esame. |

Contents | The Course consists of two modules: Institutions of International Law and Institutions of UE Law. The first one deals with the international legal order, which was created by the States starting from the Eighteen century to discipline their relationship through a mechanism of reciprocal rights and duties. The Module illustrates the fundamental characteristics of the international legal order which is completely different from the domestic legal order, from the topic of the international personality to the legal functions, namely: the jurisdiction to legislate, the jurisdiction to execute and the jurisdiction to adjudicate. The Module not only examines in depth these functions but also analyses how the international legal order aims at reaching its fundamental objectives: the coexistence among States and the maintenance of international peace and security. |

Course objectives | The Course aims at giving the students a basic knowledge of the international legal order and of the UE legal order. In particular, the Course intends to give a general foverview of the normative, adjudicative and executive functions in both the international and the EU legal orders as well as to analyse some current topics in the field. |
Prerequisites | No prerequisites are required. However, in consideration of the course’s contents, it is advisable that the students have a basic knowledge of public law and private law, according to the programs for the three-year Degree in Political Sciences, as well as some fluency in English and French. |
Teaching methods | The course is articulated in lectures (90%), in the examination of cases based on practice and/or debates (10%) for a total of 72 hours. The cases will be tackled through the analysis of the States practice and of international and EU case law. The debates will deal with current topics. |
Evaluation methods | According to the student, the evaluation will be held through an oral interview or a written test. In both cases the score is expressed in grades from 1 to 30. The minimum score to pass the exam is 18/30. The oral test consists of an interview made up of 6 questions (3 on Institutions of International Law and 3 on Institutions of EU law). The written test consists in 24 questions with multiple-choice answers (12 on international law and 12 on EU law) and 1 open answer (on international law). The exam intends to verify the standard of knowledge reached by the student on the topics indicated in the Course’s program and taught during the lessons, as well the skills in the specialized legal language of international law and EU law. |
Other information | The students can sit a partial test on the Course’s first Module, namely on the Institutions of International Law, and a final test on the second Module, namely, the Institutions of EU Law. The final score of the exam will be given by the sum of the scores obtained in the two partial tests divided by two. Partial and final tests will take place during the usual exams dates. |
