    Il Corso intende fornire le conoscenze fondamentali in materia di accertamento tributario. Nello svolgimento del corso verranno affrontati i seguenti temi:
    L’accertamento
    • Poteri investigativi e poteri di accertamento
    • La partecipazione del contribuente alla verifica tributaria
    • Metodologie di accertamento: analitica e sintetica
    • Funzione degli i studi di settore e del redditometro nell’accertamento tributario e profili critici della tutela del contribuente
    • Accertamento parziale e accertamento con adesione
    • L’avviso di accertamento ed i suoi requisiti
    • L’onere della prova e i risvolti processuali
    La riscossione
    • Le ritenute, i versamenti diretti, le iscrizioni a ruolo
    • L’esecuzione forzata tributaria e gli atti riscossione
    • La riforma della riscossione
    • Analisi delle forme di tutela del contribuente
    Le sanzioni tributarie non penali ed il penale tributario
    • Il principio di legalità ed il favor rei
    • Rapporto tra procedimento penale e procedimento tributario
    • Cenni: la frode fiscale, il falso in bilancio e i reati del sostituto d’imposta

    Per la preparazione dell'esame lo studente può fare riferimento ai principali manuali universitari di Diritto tributario (esclusi i compendi) che trattino le parti corrispondenti al programma d'esame.

    Durante il corso verranno messi a disposizione degli studenti (in formato cartaceo o elettronico) materiali didattici integrativi (slides, formulari, esempi di dichiarazioni fiscali, modelli di avvisi di accertamento, modelli verbali della GF e casi pratici) utili ad integrare l'illustrazione degli argomenti del programma.

    Obiettivi formativi

    Conoscenza e capacità di comprensione (knowledge and understanding).
    Lo studente dovrà dimostrare una conoscenza sufficiente degli argomenti indicati nel programma; dovrà dimostrare la capacità di comprendere la disciplina fiscale, con riguardo sia alle metodologie di accertamento sia alla riscossione del tributo da parte dell’Amministrazione Finanziaria.
    Conoscenza e capacità di comprensione applicate (applied knowledge and understanding).
    E’ richiesta padronanza degli schemi attuativi dei rapporti tributari, per avviarsi ad una considerazione professionale dei materiali e delle questioni e per acquisire un metodo di approccio teoricamente saldo, ma consapevole delle implicazioni pratiche.
    Autonomia di giudizio (making judgements).
    Lo studente dovrà dimostrare autonoma capacità critico/interpretativa della normativa e di collegamento delle fattispecie con gli altri esami sostenuti di diritto tributario.
    Abilità comunicative (communication skills).
    Lo studente dovrà dimostrare di saper comunicare in modo chiaro e preciso le conoscenze acquisite, di saper esprimere le proprie considerazioni e conclusioni anche nell’ambito del dibattito sui casi operativi illustrati in aula.

    Capacità di apprendere (learning skills).
    Lo studente dovrà dimostrare di aver sviluppato capacità di comprendere la complessità dei metodi accertativi da parte dell’Amministrazione finanziaria e della Guardia di Finanza e dei profili critici a tutela del contribuente.

    Prerequisiti

    Conoscenza generale dei principi di diritto tributario.

    Metodologie didattiche

    Le lezioni vengono svolte frontalmente. A seconda degli argomenti trattati verranno dedicate apposite letture all’esame di Case study.

    Metodi di valutazione

    Prova orale.
    Nella formulazione del giudizio finale troveranno applicazione i seguenti criteri valutativi:
    • Mancato superamento dell’esame: il candidato non raggiunge nessuno dei risultati descritti al punto “Obiettivi formativi”;
    • da 18 a 21: Livello sufficiente. Il candidato raggiunge, in particolare, i risultati previsti al punto “conoscenza e capacità di comprensione”;
    • da 22 a 24: Livello pienamente sufficiente. Il candidato raggiunge, in particolare, i risultati di apprendimento previsti ai punti “conoscenza e capacità di comprensione” e “conoscenza e capacità di comprensione applicate”;
    • da 25 a 26: Livello buono. Il candidato raggiunge i risultati di apprendimento previsti ai punti “conoscenza e capacità di comprensione”, “conoscenza e capacità di comprensione applicate” e “autonomia di giudizio”;
    • da 27 a 29: Livello molto buono. Il candidato raggiunge i risultati di apprendimento previsti ai punti “conoscenza e capacità di comprensione”, “conoscenza e capacità di comprensione applicate”, “autonomia di giudizio”, e “abilità comunicative”;
    • da 30 a 30 e lode: Livello eccellente. Il candidato raggiunge pienamente i risultati di apprendimento previsti ai punti “conoscenza e capacità di comprensione”, “conoscenza e capacità di comprensione applicate”, “autonomia di giudizio”, “abilità comunicative” e “capacità di apprendere”.

    The course aims to provide the fundamental knowledge in the field of tax assessment. During the course the following topics will be addressed:

    • Function of the sector and profit meter studies in the tax assessment and critical profiles of the protection of the tax payer
    • Partial assessment and assessment with acceptance

    • The burden of proof and the procedural implications
    Collection
    • Withholdings, direct payments, enrollments in the role
    • Tax enforcement and collection deeds
    • The tax collection reform
    • Analysis of the forms of protection of the tax payer
    Non-criminal tax penalties and tax penalties
    • The principle of legality and the favor rei
    • Relationship between criminal proceedings and tax proceedings
    • Outline: tax fraud, false accounting and substitute tax offenses

    For exam preparation the student can refer to the main university manuals on tax law (excluding summaries) that deal with the parts corresponding to the exam program.

    During the course, additional teaching materials will be made available to students (in paper or electronic format) (slides, forms, examples of tax returns, models of notices of assessment, verbal models of the GF and practical cases) useful for integrating the illustration of the program topics.

    Course objectives

    Knowledge and understanding (knowledge and understanding).
    The student must demonstrate a sufficient knowledge of the topics indicated in the program; must demonstrate the ability to understand the fiscal discipline, with regard to both the assessment methods and the collection of the tax by the Financial Administration.
    Applied knowledge and understanding (applied knowledge and understanding).
    Mastery of the implementation schemes of tax relations is required, to move towards a professional consideration of materials and issues and to acquire a theoretically sound method of approach, but aware of the practical implications.
    Making judgments.
    The student will have to demonstrate autonomously the critical / interpretative ability of the legislation and the connection of the cases with the other exams taken in tax law.
    Communication skills (communication skills).
    The student will have to demonstrate to be able to communicate in a clear and precise way the acquired knowledge, to be able to express his own considerations and conclusions even in the context of the debate on the operational cases illustrated in the classroom.

    Learning skills (learning skills).
    The student will have to demonstrate that he has developed the ability to understand the complexity of the assessment methods by the Financial Administration and the Guardia di Finanza and the critical profiles to protect the tax payer.

    Prerequisites

    General knowledge of tax law principles.

    Teaching methods

    The lessons are carried out frontally. Depending on the topics covered, specific readings will be dedicated to the case study exam

    Evaluation methods

    Oral exam.
    The following evaluation criteria will be applied in the formulation of the final judgment:
    • Failure to pass the exam: the candidate does not achieve any of the results described in the "Training objectives" section;
    • 18 to 21: sufficient level. The candidate achieves, in particular, the results foreseen in the point "knowledge and understanding";
    • 22 to 24: Level fully sufficient. The candidate achieves, in particular, the learning outcomes envisaged under the points "knowledge and understanding" and "applied understanding and understanding";
    • 25 to 26: Good level. The candidate achieves the learning outcomes foreseen in the points "knowledge and understanding", "applied understanding and understanding" and "autonomy of judgment";
    • from 27 to 29: Very good level. The candidate achieves the learning outcomes foreseen in the points "knowledge and understanding", "applied understanding and understanding", "autonomy of judgment", and "communication skills";
    • from 30 to 30 and praise: Excellent level. The candidate fully achieves the learning outcomes foreseen in the points "knowledge and understanding", "applied understanding and understanding", "autonomy of judgment", "communication skills" and "ability to learn".
