    Aspetti comparatistici del diritto di proprietà. Visione generale e pluralità di significati nelle diverse epoche e tradizioni.
    Sistemi di civil law e common law – Le principali esperienze europee con particolare attenzione all’evoluzione storica del concetto di proprietà in Germania e Francia. Cenni sul concetto del diritto di proprietà nelle esperienze post socialiste, nei paesi islamici e ed in Africa. Prospettiva comparativa e sguardo di insieme.
    Il modello inglese. Principi e caratteristiche principali del sistema di common law. L’origine de concetto di appartenenza feudale. La property e la law of property (personal property e real property. I concetti di ownership e possession. Gli estates. I diritti reali immobiliari. La nascita dell’equity, confronto con il common law. Trusts. Analisi comparativa.
    Politiche e progetti per l'efficienza energetica. Approfondimento di alcune esperienza straniere (Spagna, UK, Brasile). La “nuova” figura di consumatore di energia e lo sviluppo di un modello di città sostenibile.

    Per gli studenti lavoratori è previsto un programma didattico dedicato con approfondimento dei temi fondamentali dell’insegnamento con particolare riferimento alla concezione della proprietà e situazioni di appartenenza nei principali sistemi di common law (con attenzione al sistema nel Regno Unito) e civil law.
    Nonchè con riferimento alle politiche e progetti per l'efficienza energetica e tutela dell’ambiente

    Obiettivi formativi

    Conoscenza e capacità di comprensione
    Lo studente dovrà utilizzare il metodo x la comprensione di una visione completa-in ottica comparativa-in materie specifiche quali il diritto di proprietà e l'energia,con particolare attenzione a tematiche attuali quali la tutela dell'ambiente e lo sviluppo sostenibile e le relative problematiche nei principali paesi europei.
    Conoscenza e capacità di comprensione applicate
    Lo studente dovrà essere in grado di illustrare come è oggi concepito il diritto di proprietà nelle tradizioni giuridiche occidentali e non,tenendo conto dell’evoluzione storica–politico-sociale del concetto di situazione di appartenenza.Dovrà ampliare il proprio angolo di visuale e attraverso il metodo comparativo cogliere le analogie e differenze delle tradizioni giuridiche,con riferimento a problemi attinenti l’energia e l’ambiente in ottica propositiva
    Autonomia di giudizio
    Lo studente dovrà valutare e analizzare in maniera autonoma le differenze principali del concetto di proprietà e di appartenenza nelle tradizioni giuridiche e le ragioni politiche-sociali-storiche sottese a tali differenze.In relazione al concetto di energia e ambiente,dovrà essere in grado di giudicare le principali criticità in modo propositivo
    Abilità comunicative
    Lo studente deve essere in grado di spiegare a persone non esperte le nozioni di base del concetto di proprietà e le principali problematiche attinenti l’energia e l'ambiente.Imparerà a familiarizzare con i termini della disciplina proprietaria ed a trasmettere a non esperti i principi e i contenuti con semplicità
    Capacità di apprendere Lo studente dovrà dimostrare di aver sviluppato capacità di comprendere la complessità del concetto di appartenenza e di proprietà nel diritto comparato,le capacità di apprendimento che possono consentirgli di proseguire nello studio della comparazione intesa come scienza giuridica in modo autonomo e consapevole,anche con aggiornamento costante delle proprie competenze

    E’ preferibile aver sostenuto l’esame di diritto privato comparato (sistemi giuridici comparati)

    STUDENTI LAVORATORI
    Seminari di didattica integrativa con oggetto gli elementi fondamentali della disciplina per offrire adeguati strumenti per la comprensione del programma stesso e per rendere edotto lo studente circa modalità e standard della prova di esame.
    Verrà inoltre sottoposto agli studenti-lavoratori un test di autovalutazione articolato in capitoli secondo le diverse aree tematiche trattate (con almeno dieci domande per ogni CFU).

    Metodi di valutazione

    Esame orale.
    La prova orale si prefigge l’obiettivo di accertare le capacità dello studente di saper descrivere come è oggi concepito il diritto di proprietà nelle principali tradizioni giuridiche occidentali e la capacità di ampliare il proprio angolo di visuale ed essere in grado di cogliere le analogie e differenze delle varie tradizioni giuridiche, anche con riferimento ai problemi attinenti l’energia e l’ambiente.
    Si verificherà anche la capacità di spiegare e illustrare in modo semplice le nozioni di base del concetto di proprietà e le principali problematiche attinenti l’energia ed ambiente.
    La prova orale si svolgerà con un colloquio articolato in 6 domande sugli argomenti del diritto di proprietà in ambito comparatistico e le principali problematiche attinenti l’energia ed ambiente atto ad accertare il livello di conoscenze raggiunto dallo studente
    Non è consentito consultare vocabolari, prontuari, testi o materiali didattici o informatici durante l'esame.

    Sarà valutata in (trentesimi) ed il superamento dell’esame si otterrà con un voto minimo di 18/30. Per ogni risposta, per il superamento della prova, la valutazione minima è 3 ed la massima è 5.
    Il voto 3 alla singola risposta verrà attribuito laddove lo studente dimostri, sia pur con qualche incertezza, quanto meno un livello di conoscenza e apprendimento minimo delle materie specifiche dell'insegnamento tenendo conto degli obiettivi attesi e prefissati dell'insegnamento.
    Il punteggio medio di 4 alla singola risposta verrà attribuito laddove lo studente dimostri un adeguato livello di conoscenza e apprendimento unitamente ad una buona capacità espositiva tenendo conto degli obiettivi attesi e prefissati dell'insegnamento.
    Il voto massimo di 5 alla singola risposta verrà attribuito laddove lo studente dimostri una spiccata comprensione delle materie del diritto di proprietà e l'energia, con elevata capacità espositiva e di analisi delle differenze principali nelle tradizioni giuridiche.

    STUDENTI LAVORATORI

    La prova di esame è scritta o orale, a scelta dello studente lavoratore. La prova di valutazione scritta degli studenti lavoratori, in forma di questionario, è articolata in due sezioni:
    - la prima contempla quindici domande a risposta multipla, che traggono spunto dai quesiti sottoposti agli studenti attraverso i test di autovalutazione;
    - la seconda prevede tre domande a risposta aperta, adeguate a saggiare l’effettiva comprensione degli snodi critici relativi agli elementi fondamentali del programma dell’insegnamento;
    Ai fini della valutazione finale, ciascuna sezione inciderà nella misura del 50%.
    La prova di esame in forma scritta ha una durata minima di 60 minuti e una durata massima di 120 minuti.

    Comparative aspects of property law. General vision and plurality of meanings in different eras and traditions.
    Civil law and common law systems - The main European experiences with particular attention to the historical evolution of the concept of property in Germany and France. Notes on the concept of property law in post-socialist experiences, in Islamic countries and in Africa. Comparative perspective and overall view.
    The English model. Principles and main features of the common law system. The origin of the concept of feudal belonging. The property and the law of property (personal property and real property. The concepts of ownership and possession. The estates. Real estate rights. The birth of equity, comparison with the common law. Trusts. Comparative analysis.

    Policies and projects for energy efficiency. Deepening of some foreign experiences (Spain, UK, Brazil). The "new" figure of energy consumer and the development of a sustainable city model.

    For working students there is a dedicated educational program with in-depth study of the fundamental teaching themes with particular reference to the conception of ownership and belonging situations in the main common law systems (with attention to the system in the United Kingdom) and civil law.

    Course objectives

    Knowledge and understanding
    The student will be able to use the method x to understand a complete vision - in a comparative perspective - in specific subjects such as property law and energy, with particular attention to current issues such as environmental protection and sustainable development and related problems in the main European countries

    Applied knowledge and understanding
    The student will have to be able to illustrate how the right of ownership is conceived in Western and non-Western legal traditions, taking into account the historical-political-social evolution of the concept of belonging situation. It will have to widen its angle of view and through the comparative method to grasp the analogies and differences of legal traditions, with reference to problems concerning energy and the environment from a propositional point of view
    Autonomy of judgment
    The student must be able to evaluate and analyze independently the main differences of the concept of ownership and belonging in legal traditions and the political-social-historical reasons underlying these differences. In relation to the concept of energy and environment, it must be in able to judge the main critical points in a proactive way
    Communication skills
    The student must be able to explain to non-experts the basic concepts of the concept of property and the main issues concerning energy and the environment. Learn to become familiar with the terms of the proprietary discipline and to pass on the principles and content with simplicity
    Learning skills The student will have to demonstrate that he has developed the ability to understand the complexity of the concept of belonging and ownership in comparative law, the learning skills that can allow him to continue in the study of comparison as a legal science in an autonomous and conscious way, also with constant updating of their skills

    It is preferable to have taken the exam of comparative private law (comparative legal systems)

    WORKING STUDENTS

    Integrative teaching seminars with the subject of the fundamental elements of the discipline to offer adequate tools for understanding the program itself and to inform the student about the methods and standards of the exam.
    Students-workers will be subjected to a self-assessment test divided into chapters according to the different thematic areas dealt with (with at least ten questions for each CFU).

    Evaluation methods

    Oral exam.
    The oral exam aims to ascertain the student's ability to describe how the right of ownership is conceived today in the main Western legal traditions and the ability to expand their angle of view and be able to grasp the similarities and differences of the various legal traditions, also with reference to problems related to energy and the environment.
    The ability to explain and illustrate in a simple way the basic notions of the concept of property and the main problems related to energy and the environment will also be verified.
    The oral exam will take place with an interview divided into 6 questions on the topics of property law in the comparative field and the main problems related to energy and the environment to ascertain the level of knowledge achieved by the student
    It is not allowed to consult vocabularies, handbooks, texts or teaching or computer materials during the exam.

    It will be evaluated in (thirtieths) and passing the exam will be obtained with a minimum grade of 18/30. For each answer, for passing the test, the minimum evaluation is 3 and the maximum is 5.
    The grade 3 to the single answer will be attributed where the student demonstrates, albeit with some uncertainty, at least a minimum level of knowledge and learning of the specific subjects of the course taking into account the expected and set objectives of the teaching.
    The average score of 4 to the single answer will be assigned where the student demonstrates an adequate level of knowledge and learning together with the expository capacity in relation to the expected and set objectives of the course.
    The maximum grade of 5 to the single answer will be awarded where the student demonstrates a strong understanding of the subjects of property law and energy, with expository skills and analysis of the main differences in legal traditions.

    WORKING STUDENTS

    The exam is written or oral, at the choice of the working student. The written assessment test for working students, in the form of a questionnaire, is divided into two sections:
    - the first includes fifteen multiple choice questions, which draw inspiration from the questions submitted to students through self-assessment tests;
    - the second involves three open-ended questions, adequate to test the effective understanding of the critical issues relating to the fundamental elements of the teaching program;
    For the purposes of the final evaluation, each section will affect the amount of 50%.
    The written exam has a minimum duration of 60 minutes and a maximum duration of 120 minutes.
