Contenuti | Il corso è inteso a stimolare una riflessione sul processo evolutivo dello Stato nell’esperienza occidentale, esaminando le evoluzioni che nel lungo periodo hanno caratterizzato il processo di regolazione dell’esercizio delle funzioni pubbliche. In questo percorso si analizzerà la singolare evoluzione del diritto amministrativo che, fin dalle sue origini, ha caratterizzato la natura e il modo di operare dell’amministrazione pubblica continentale. |

Obiettivi formativi | Conoscenza e capacità di comprensione della genesi dello Stato moderno e del processo di costruzione delle istituzioni politiche e dei modelli di interpretazione giurisprudenziale e scientifica del diritto, attraverso l’analisi del funzionamento dei diversi sistemi politico-costituzionali ai fini della concreta comprensione dei meccanismi di funzionamento e di evoluzione delle istituzioni pubbliche e dei soggetti politico-amministrativi (1 - knowledge and understanding) Conoscenza e capacità di comprensione applicate in maniera critica nello studio delle fonti storico-giuridiche di riferimento ai fini della contestualizzazione temporale e dell’interpretazione dei problemi giuridici e dei rapporti di forze nonché delle principali soluzioni individuate nelle diverse epoche. Programma del corso | Il corso si propone di preparare lo studente ad un'adeguata conoscenza della storia dell’amministrazione dello Stato e del suo diritto. Affermatosi in Francia come strumento del dispotismo governativo e diffuso con grande ritardo sulla scena degli ordinamenti giuridici ha poi subito una forte accelerazione, allargando il proprio campo di azione ad una grande quantità di materie, con regolazioni sempre più analitiche. |

Contents | The course is intended to stimulate reflection on the evolutionary process of the State in Western experience, examining the evolutions that have characterised the process of regulating the exercise of public functions over the long term. This course will analyse the unique evolution of administrative law that, from its origins, has characterised the nature and mode of operation of continental public administration. |

Course objectives | Knowledge and understanding of the genesis of the modern state and the process of building political institutions and models of jurisprudential and scientific interpretation of law, through the analysis of the functioning of the various political-constitutional systems for the purpose of a concrete understanding of the mechanisms of functioning and evolution of public institutions and political-administrative subjects (1 - knowledge and understanding) Knowledge and ability to understand applied critically in the study of historical-legal sources of reference for the purpose of temporal contextualisation and interpretation of legal problems and relations of forces as well as of the main solutions identified in the various periods. Ability to grasp the historical dimension of legal language and the not only normative but also political profiles of law (2 - applied knowledge and understanding) Autonomy of judgement in interpreting sources and historical-political processes, based on the critical understanding of legal knowledge and political phenomena in a systematic and interdisciplinary key (3 - making judgements) Communication skills in clearly and unambiguously expressing one's own knowledge (in written or oral form), be able to express their considerations and conclusions also in the context of the debate on cases subject to specific collective analysis (working class) that may take place in the course of the lectures or in the thematic in-depth seminars organised. Teaching methods | The student can acquire knowledge and understanding through the use of traditional forms of teaching (frontal teaching: lectures, tutorials, etc.). |
Evaluation methods | Oral test or written test. For the written test, a prior request must be made to the lecturer (Questo indirizzo email è protetto dagli spambots. Both modes of learning assessment aim to ascertain the level of knowledge of the topics indicated in the syllabus and to verify that the student has acquired knowledge of the discipline, the ability to interpret phenomena, and the capacity for clear and reasoned exposition in coherence with the descriptors of the learning outcomes indicated in the Training Objectives field. The oral test consists of a structured interview and the assessment respects the following criteria - Failure to pass: insufficient preparation - 18 to 21: sufficient preparation with specific regard to point 1 of the Learning Objectives - 22 to 24: fully sufficient preparation with specific regard to points 1 and 2 of the Learning Objectives - 25 to 26: good preparation with specific regard to points 1, 2, and 3 of the Learning Objectives - 27 to 29: very good preparation with specific regard to points 1, 2, 3, and 4 of the Learning Objectives - 30 to 30 cum laude: very good/excellent preparation with specific regard to points 1, 2, 3, 4, and 5 of the Learning Objectives. The written test consists of a test comprising 15 multiple-choice questions and 4 open-ended questions. The assessment corresponds to the marks accrued for the answers given to the test questions: - for each multiple-choice question, the correct answer carries a mark of 1; - for each open-ended question, the correct answer carries a mark from 0 to 4 depending on whether the answer demonstrates an insufficient, sufficient, good, very good or excellent level of preparation; - the correct answer to all the multiple-choice questions combined with the answer demonstrating an excellent level of preparation for all the open-ended questions carries a final mark of 30 with distinction; - failure to achieve the minimum mark of 18/30 results in failure to pass the examination. |

Course Syllabus | The course aims to prepare the student for an adequate knowledge of the history of state administration and its law. Established in France as an instrument of governmental despotism and spread with great delay on the scene of legal systems, it then underwent a strong acceleration, widening its scope to a large number of subjects, with increasingly more analytical regulations. |
