Contenuti | Il corso di filosofia del diritto si propone di ricostruire il concetto di equità, intesa non come categoria meramente classificatoria ma costitutiva del diritto. In quest’ottica il dettato normativo diventa precipitato attuativo dell’equità, che viene elevata a presupposto metodologico. Si tratterà, altresì, della distinzione tra diritto e legge attraverso un excursus che, a partire dal mondo classico, avrà l’ambizione di evidenziare le principali contraddizioni dell’età contemporanea. Particolare attenzione sarà posta all’inquadramento teorico della categoria equitativa che costituirà il filtro ermeneutico per l’analisi dei profili autoritativi della legge e del rapporto tra rappresentanza, processo decisionale e organizzazione statale. |

Obiettivi formativi | L’insegnamento si propone di introdurre gli studenti ai concetti di base e alle principali prospettive teoriche della Filosofia del diritto. |

Metodologie didattiche | Il corso, di 36 ore, prevede una didattica frontale con lezioni interattive supportate da slides e materiali audiovisivi. Sono previste, inoltre, attività laboratoriali, con presentazioni di case studies e attività seminariali. |
Metodi di valutazione | La valutazione dell’apprendimento sarà effettuata tramite esame orale con votazione in trentesimi. I criteri di valutazione sono: la correttezza e chiarezza espositiva dei contenuti, la capacità di analisi critica e di contestualizzazione storica degli argomenti affrontati, la comprensione degli argomenti affrontati, la capacità di dimostrare l’effettivo raggiungimento degli obiettivi formativi. Il candidato che non soddisfa nessuno dei criteri indicati e non raggiunge nessuno dei risultati descritti al punto “Obiettivi formativi” non supera l’esame. |

Contents | The course of philosophy of law aims to reconstruct the concept of equity, understood not as a category merely classificatory but constitutive of law. In this perspective, the normative dictate becomes precipitate implementation of equity that is elevated to a methodological prerequisite. It will also deal with the distinction between law and law through an excursus that, starting from the classical world, will have the ambition to highlight the main contradictions of the contemporary age. Particular attention will be paid to the theoretical framework of the equestrian category that will constitute the hermeneutic filter for the analysis of the authoritative profiles of the law and the relationship between representation, decision-making and state organization. |
